Royalty-Free License

Your rights to use any stock art from Solid Stock Art, LLC, and its site are subject to this Agreement and are conditioned upon your payment to Solid Stock Art, LLC for your use of the stock art. If your payment fails, is refused or canceled, or is fraudulent, your account will be deemed to be delinquent and any rights of use of any stock art may be automatically terminated without notice.

Your payment for the use of any non-watermarked stock art purchases a royalty-free license, which grants the license holder, and your employer, employee, client, or agent, the right to use such purchased royalty-free stock art for advertising purposes as many times as you like for fine art, prints, websites, blogs, website templates, email templates, educational templates, templates for resale, newsletters, books, newspapers, booklets, videos, television, flyers, software, apps, or any other advertising or promotional materials. This agreement does not grant the right to resell or redistribute as stated in detail below.

Any watermarked and unwatermarked thumbnail stock art, however, is copyrighted and not subject to a royalty-free license but may be used for mock-ups, comps, and reviews as an internal placeholder for the unwatermarked stock art. You may not publish, print, or distribute the watermarked image in any way, except: you may link back to the original content provided it is for the sole purpose of exposure and promotion and not for personal gain. This exception includes sharing watermarked images via social media outlets, such as facebook, pinterest, and twitter. Each artist has the right and option to revoke socially sharing their content.

The Royalty-Free License does not include a license to any person, place or property, or subject matter depicted in the stock art, which may be subjected to copyrights, trademarks, rights of publicity, or moral rights. Solid Stock art makes no representations or warranties that it owns or licenses any rights.

A model or property release permitting reproduction and approving the Royalty-Free use of the stock art and otherwise approving the terms of use, and must be signed and attached to the stock art by the artist during the upload process. It is the artist's responsibility to retain and attach a complete and signed release for any recognizable person(s) or copyrighted property. By using such images, the artist hereby certifies that the information contained within the release is complete and accurate. Solid Stock Art, LLC's liability shall be limited to the amount paid to Solid Stock Art, LLC, for the use of the stock art.

Unauthorized Use

Any licenses associated with the site may not be transferred, sub-licensed, given away, assigned, or resold. For example if you download stock art for your current employer, but leave that company, you may not take and reuse the stock art. The stock art belongs to the company that paid for the license. Notwithstanding the foregoing, a company whose business is creating marketing (e.g., an advertising firm) may market multiple companies with purchased stock art, but may not give, sell, transfer, or lend the stock art to their customers—in other words, the license only permits the marketing/advertising firm to produce creative materials on behalf of their client, but the client has no rights under the license. This license does not grant you the right to re-sell, share, or alter with intent to re-sell where the artwork is the product intended for resale; however, where the stock art is used to create a product, or becomes part of the product, the license grants such use, such as calendars, clothing, book cover, website templates, blogs, newsletters, product packaging, etc), any stock art. A franchisor may permit a franchisee to use the stock art, but in no case shall any other affiliate, subsidiary, or other related entity or individual related to you be permitted to use the stock art.

Stock art may not be included in or made part of a company brand or logo with intent to hold a copyright.

Stock art may not be used for any pornographic, indecent, obscene, or unlawful purpose, to defame any person or legal entity, to violate a person's right to privacy or publicity, or to infringe upon any copyright, trade name, trademark, or service mark of any person or legal entity. Unauthorized use of the stock art constitutes copyright infringement and shall entitle Solid Stock Art, LLC, to exercise all rights and remedies under applicable copyright law, including seeking an injunction preventing further use and monetary damages against all users and beneficiaries of the use of such stock art.

You the buyer are solely responsible for the use of any stock art in combination with any other material, and you agree not to use stock art in any way involving any sensitive or controversial matters, including but not limited to sexual activity or content, crime, demoralizing subjects, same-sex subject matter, substance abuse, or any other indecent or offensive content that may offend, demoralize, or negatively portray a model or artist. Without limiting the foregoing, and by way of example: Editing or adding copy or graphics to stock art that is taken out of context that may offend, or demoralize a model’s persona. Solid Stock Art, LLC, desires to protect that model’s subjective sensibilities.
